N.H. Supreme Court overturns murder conviction for father of Harmony Montgomery

The New Hampshire Supreme Court has overturned the murder conviction of Adam Montgomery, the father of Harmony Montgomery, a 5-year-old girl whose disappearance and death became one of the state’s most closely followed cases.

The court’s decision does not end the legal battle. Instead, the ruling sends the murder charge back to a lower court for further proceedings while leaving several other convictions in place.

Court Rules Combined Charges Affected Fair Trial Rights

Montgomery was previously convicted of second-degree murder in 2024 and sentenced to decades in prison. His defense team appealed the decision, arguing that the way the charges were handled during the trial created an unfair situation for the jury.

The Supreme Court agreed that combining the murder charge with an assault-related charge involving Harmony may have influenced the jury’s decision. The justices ruled that evidence from one allegation could have unfairly affected how jurors viewed the more serious charge.

Other Convictions Remain in Place

Although the murder conviction was reversed, the court allowed other convictions against Montgomery to stand, including charges related to evidence handling, witness issues, and abuse of Harmony’s remains.

Montgomery also remains behind bars because of a separate sentence connected to an unrelated weapons case.

Case Surrounding Harmony Montgomery Drew National Attention

Harmony Montgomery was reported missing in 2021, more than two years after investigators believe she was last seen alive. Authorities believe she died in 2019, but her remains have never been recovered.

The original trial relied heavily on testimony from people close to the family as prosecutors presented their case against Montgomery.

Prosecutors Plan to Continue Pursuing the Case

Following the Supreme Court decision, prosecutors said they intend to continue seeking a murder conviction through a new legal process. Officials stated that they remain committed to pursuing justice for Harmony.

The ruling creates a new chapter in a case that has already involved years of investigation, courtroom proceedings, and public attention.

Legal Experts Watch Next Steps in High-Profile Case

The decision highlights the importance of trial procedures and defendants’ rights, even in cases involving serious allegations.

As the case moves forward, attention will remain on whether prosecutors bring the murder charge to trial again and what evidence will be presented in the next stage of the legal process.
