An Oklahoma father who admitted taking a “gulp” of vodka before causing a devastating rollover crash that killed his 16-year-old daughter has learned his fate in court. The case drew widespread attention because of the tragic circumstances surrounding the crash, his decision to flee the scene, and the emotional divisions within his own family over how he should be punished.

Elliott Lincoln Binney, 43, was sentenced to five years in prison after pleading guilty to multiple criminal charges connected to the death of his daughter, Shelby Binney. Prosecutors argued that his reckless driving led directly to the fatal crash and that his actions afterward made the tragedy even more disturbing.

The Fatal Crash

Dangerous Driving in Poor Weather

The crash occurred on January 11, 2024, near East 171st Street South in Oklahoma. According to investigators, Binney was driving with his wife Brittany and their three children when he attempted to pass other vehicles despite rainy conditions and a slick roadway. Witnesses reported that he was traveling at a high rate of speed and crossed into a no-passing zone shortly before losing control of the vehicle.

Authorities said the vehicle rolled over, causing catastrophic injuries to those inside. The crash ejected 16-year-old Shelby Binney from the vehicle. Emergency responders later determined that her injuries were fatal.

Open Bottle of Vodka Found at Scene

Investigators discovered an open bottle of vodka at the crash site. During the investigation, Binney admitted that he had taken a “gulp” of vodka moments before the collision occurred. His wife also told investigators that he had been drinking while driving.

Despite the presence of alcohol, prosecutors later acknowledged that they could not prove beyond a reasonable doubt that Binney was legally impaired at the time of the crash. However, they maintained that there was ample evidence proving he drove recklessly and caused the fatal collision.

Shelby Binney Dies From Her Injuries

Teenager Ejected From Vehicle

When first responders arrived, they found Shelby outside the vehicle after she had been thrown from the SUV during the rollover. Authorities reported that she was not expected to survive. She later died from her injuries.

Meanwhile, Binney’s wife and two other children remained trapped inside the vehicle. Emergency crews removed them from the wreckage and transported them to a hospital for treatment.

The death of Shelby became the central focus of the criminal case that followed.

Father Flees the Scene

Running Away Instead of Helping Family

Perhaps the most shocking aspect of the case was what happened immediately after the crash.

Rather than staying with his severely injured daughter, wife, and children, authorities said Binney fled on foot before first responders arrived. Prosecutors emphasized that he abandoned his family at one of the most critical moments of their lives.

Tulsa County District Attorney Steve Kunzweiler later told the court that Binney left his wife and surviving children behind in the crashed vehicle while Shelby lay dying.

Arrested Miles Away

Investigators said Binney eventually obtained another vehicle from a nearby business and left the area. Authorities later tracked him down in Checotah, Oklahoma, approximately 40 to 50 miles from the crash scene. He was arrested after being located by law enforcement officers.

After his arrest, Binney reportedly apologized for passing vehicles in the rain and attempted to explain the crash by claiming the vehicle may have hit an oil spot on the roadway. He also admitted leaving the scene.

Criminal Charges and Guilty Plea

Multiple Charges Filed

Prosecutors charged Binney with several crimes arising from the fatal crash. He eventually pleaded guilty to:

  • First-degree manslaughter
  • Child neglect
  • Leaving the scene of a fatal accident
  • Transporting an open container of alcohol

As part of a plea agreement, prosecutors dropped additional charges, including reckless driving and certain traffic-related offenses.

Prosecutor’s Position

District Attorney Steve Kunzweiler emphasized that the case was not primarily about proving intoxication but rather about reckless conduct and abandoning injured victims.

According to the prosecutor, what could be proven was Binney’s dangerous driving, the death of his daughter, injuries suffered by other family members, and his decision to flee after causing the crash.

Kunzweiler described the circumstances as deeply tragic but maintained that criminal accountability was necessary.

Family Divided Over Punishment

Wife Defends Husband

One unusual aspect of the case was that Brittany Binney opposed a lengthy prison sentence for her husband.

In a statement to the court, she argued that poor weather conditions—not intoxication or recklessness—were responsible for the crash. She insisted that her husband was not impaired and described him as a loving father who had already suffered enormously because of Shelby’s death.

Brittany told the judge that the loss of their daughter would haunt him forever and that imprisonment would only deepen the suffering already experienced by the family.

Concern for Remaining Children

Brittany also expressed concern for their surviving children.

She told the court that they were already struggling with the devastating loss of their sister and feared that sending their father to prison would inflict another major emotional wound on the family.

However, prosecutors argued that the seriousness of the crime required incarceration regardless of the family’s wishes.

Judge Delivers Sentence

Five Years in Prison

After reviewing the evidence and considering statements from both sides, the judge imposed a five-year prison sentence on Binney. The sentence fell within the range recommended by prosecutors under the plea agreement.

The court concluded that prison time was warranted because of the reckless driving that caused Shelby’s death and Binney’s decision to flee the scene rather than remain with his injured family.

Immediate Custody

Following his guilty plea and sentencing proceedings, Binney was taken into custody. The case that began with a tragic family road trip ended with a prison sentence and a permanent loss that will continue to affect everyone involved.

Previous Legal History Revealed

Court records examined during reporting on the case revealed that Binney had previously faced charges for leaving the scene of an accident on four separate occasions. Although those earlier charges were ultimately dismissed, the history became a notable aspect of public discussion surrounding the case.

Lasting Impact of the Tragedy

The death of Shelby Binney remains at the heart of the case. Prosecutors repeatedly emphasized that a teenage girl lost her life because of reckless decisions made behind the wheel. They also stressed that fleeing the scene left an especially troubling impression on investigators and the public.

While Shelby’s mother argued that the emotional burden of losing a child would be punishment enough for Binney, the court ultimately determined that a prison sentence was necessary. The case serves as a stark reminder of the devastating consequences that can result from reckless driving, alcohol consumption behind the wheel, and abandoning victims after a crash.
