An Ohio bar owner who admitted he was drunk after striking and dragging a 9-year-old girl with his Hummer has been sentenced to prison in a case that shocked the community and drew national attention. The incident left the young victim with life-altering injuries, including the loss of her left leg below the knee.

Despite the devastating consequences, the courageous child addressed the defendant in court and offered forgiveness. However, the judge was not persuaded to show leniency and imposed the maximum sentence allowed under the plea agreement.

The July 2024 Crash That Changed a Child’s Life

Young Girl Was Riding Her Bicycle Through a Crosswalk

The crash occurred in Dayton, Ohio, in July 2024. Ashley Escalante, who was 9 years old at the time, was riding her bicycle with a friend and crossing the street when she was struck by a Hummer driven by Jeffrey Atkinson.

Authorities said Atkinson failed to stop after hitting the child. Instead, Ashley became trapped beneath the vehicle and was dragged for a significant distance down the road. The horrifying incident unfolded in front of family members and witnesses who desperately tried to stop the vehicle.

Child Dragged for Approximately Half a Mile

According to investigators, Ashley was dragged roughly half a mile after becoming caught underneath the Hummer. Video evidence reportedly showed her father running after the vehicle while carrying another child in his arms as he attempted to save his daughter.

Emergency responders later found Ashley suffering catastrophic injuries.

Severe Injuries Resulted in Leg Amputation

First Responders Found Horrific Injuries

When officers and emergency personnel located Ashley, they discovered that the lower portion of her left leg was missing below the knee. She also suffered major injuries to her right leg.

The injuries were so severe that doctors ultimately could not save the lower part of her left leg. The amputation permanently altered the course of her life.

Child Recalled Terrifying Moments After Impact

According to reports cited during the investigation, Ashley cried out after the collision, saying:

“I don’t want to die! Is this a dream?”

The statement reflected the fear and trauma she experienced during the incident.

Police Tracked Driver to His Bar

Officers Found Atkinson at His Business

After the hit-and-run, police tracked the Hummer to a local establishment known as Cowboys Lodi Bike Stop, a bar owned by Jeffrey Atkinson.

Body-camera footage later released by authorities showed officers confronting Atkinson at the business after the crash. When asked whether he owned the Hummer parked outside, Atkinson acknowledged that he did.

Driver Made Damaging Admissions

The body-camera footage captured several incriminating statements.

When officers attempted to administer field sobriety testing, Atkinson reportedly admitted he was too intoxicated to pass. He openly acknowledged being impaired and made several statements that would later become central to public attention.

Among the remarks captured on camera were:

“Oh f— that, I’m already impaired.”

and

“You know what? F— it, I’m drunk. I’ll admit it. I own a bar.”

Blood Alcohol Level Was More Than Four Times Legal Limit

Investigators determined that Atkinson’s blood alcohol concentration measured 0.34.

The legal limit for drivers in Ohio is 0.08, meaning his BAC was more than four times the legal threshold. Authorities cited this extreme level of intoxication as evidence of the danger he posed behind the wheel.

Criminal Charges Filed Against the Bar Owner

Multiple Felony Charges Pursued

Prosecutors pursued several serious charges against Atkinson, including:

  • Aggravated vehicular assault
  • Child endangerment
  • Failure to stop after an accident
  • Operating a vehicle while impaired (OVI)

The charges reflected both the severity of Ashley’s injuries and Atkinson’s decision to leave the scene after the collision.

Guilty Plea Entered

Rather than proceed to a full trial, Atkinson entered guilty pleas to the charges in Montgomery County Common Pleas Court.

His plea acknowledged responsibility for the conduct that led to Ashley’s catastrophic injuries.

At the sentencing hearing, Ashley—now approaching her 11th birthday—addressed the court directly.

“That day, I lived the greatest fear that a human being can feel, being on the verge of death.”

She also stated:

“Because of your act of cruelty, my life changed forever.”

Child Chose Forgiveness

One of the most emotional moments in the courtroom came when Ashley announced that she forgave the man responsible for her injuries.

She said:

“I forgive you. Not because you deserve it but because my heart doesn’t deserve to live full of hatred. I don’t want resentment to control my life.”

Her remarks drew widespread attention because of the maturity and compassion she demonstrated despite suffering permanent injuries.

Judge Rejects Leniency and Imposes Maximum Sentence

Seven Years in Prison

Although Ashley expressed forgiveness, the court determined that the seriousness of the offense required substantial punishment.

The judge imposed the maximum sentence available under the circumstances, ordering Atkinson to serve seven years in prison.

Driving Privileges Suspended

In addition to the prison term, Atkinson received a 10-year driver’s license suspension.

The penalty ensures that he will be prohibited from legally operating a vehicle for a decade following the sentence imposed by the court.
