3-year-old boy shot dead as he sat on the living room couch watching TV with his 9-year-old brother — Tragic
A heartbreaking case out of Athens, Georgia, has ended with prison sentences for four men responsible for a drive-by shooting that claimed the life of 3-year-old Kyron Santino Zarco Smith. The toddler was sitting on a living room couch watching television with his 9-year-old brother when a barrage of bullets tore through their home. Kyron was struck in the chest and died from his injuries, while his older brother survived after suffering a non-life-threatening gunshot wound.
The shooting occurred on March 8, 2024, at the Hallmark Mobile Home Park in Athens. Authorities later determined that the children were not the intended targets. Instead, the gunmen were allegedly seeking to attack a rival gang member.
Four Men Held Responsible
The final defendant in the case, 19-year-old Julian Cubillos, pleaded guilty to voluntary manslaughter and was sentenced to 20 years in prison. His plea marked the conclusion of the criminal proceedings connected to Kyron’s death.
Three other defendants had already been convicted:
Desmontrez “Ten” Mathis
Mathis, 24, was found guilty by a jury on charges including malice murder and received a life sentence in prison, along with additional years of supervision.
Jayden “Gloxky” Brown
Brown, 18, pleaded guilty and was sentenced to life in prison with the possibility of parole, plus additional probation time.
Dakious “Third” Echols
Echols, 20, also pleaded guilty and received a life sentence with parole eligibility and additional probation requirements.
Prosecutors Say the Attack Was Gang-Related
According to the Georgia Attorney General’s Office, Mathis, Brown, and Echols were members of the gang known as “Everybody Eats” (EBE). Prosecutors said the men, along with Cubillos, traveled to Hallmark Mobile Home Park intending to target a rival gang member. Investigators alleged that the attack was motivated by a desire to increase their status within the gang.
When they arrived at the mobile home park, the group opened fire. Instead of hitting their intended target, bullets entered a residence where Kyron and his 9-year-old brother were sitting on a couch watching television.
The Innocent Victims
Kyron Santino Zarco Smith was only three years old when he was killed. His 9-year-old brother was beside him during the shooting and survived his injuries. Prosecutors described the children as completely innocent victims caught in a gang dispute that had nothing to do with them.
The loss devastated the family and shocked the Athens community. Officials repeatedly emphasized that a young child lost his life because of reckless gang violence.
Mother Speaks About Her Son’s Death
Kyron’s mother, Shanita Smith, spoke publicly after the convictions and described feeling relief that those responsible had been held accountable. She said the guilty verdicts felt like an answer to prayers she had been waiting on for a long time.
Smith also revealed that the family eventually moved away from Athens following the tragedy. The emotional impact of the shooting continues to affect every member of the family.
The Burden Carried by Kyron’s Older Brother
One of the most painful aspects of the tragedy, according to Smith, is the guilt carried by Kyron’s oldest brother. Reports indicated that the gunmen may have been targeting him. Smith said her son struggles with the belief that circumstances surrounding him ultimately led strangers to show up at their home and open fire.
She described the entire situation as senseless and said it still does not make sense to the family.
A Mother’s Final Moments Before the Shooting
In earlier interviews following the tragedy, Smith recounted that Kyron had been sick on the day of the shooting. Because of his illness, she stayed home from work to care for him. Later that evening, she left briefly to buy her son his favorite candy.
While she was returning home, the shooting occurred. Recalling the moment, she tearfully said she still had Kyron’s gummies and dinner sitting in her car after learning what had happened.
Statement From Georgia’s Attorney General
Following the convictions, Georgia Attorney General Chris Carr issued a statement expressing sympathy for Kyron’s family while stressing the need to continue fighting gang-related crime. He described the shooting as senseless and said children and families deserve better. Carr added that while no legal outcome could bring Kyron back, officials hoped the convictions would provide some measure of peace and justice for the family.
Why Julian Cubillos Received a Lesser Sentence
Authorities explained that Cubillos received a lesser sentence than the other defendants because he was not the shooter and cooperated with investigators during the case. His guilty plea to voluntary manslaughter resulted in a 20-year prison sentence rather than the life terms imposed on the others.
Community Impact and Lasting Legacy
The death of Kyron Santino Zarco Smith became one of the most heartbreaking examples of innocent children becoming victims of gang violence. A toddler watching television in his own living room lost his life because gunmen fired into a home while pursuing a gang-related objective. The case drew widespread attention across Georgia and renewed discussions about gang activity, public safety, and the devastating consequences of gun violence.
Although the convictions have brought legal closure, the pain remains for Kyron’s family, who continue to mourn a little boy whose life was cut tragically short while simply sitting on a couch beside his brother and watching television.
